Terms of Use

These Terms of Use ("Terms") govern your access to and use of startfive (the "Service"), a public influencer leaderboard where rank is determined by the amount paid for a listing. By using the Service or making a payment, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. If you act on behalf of an organization, you represent that you are authorized to bind it.

2. The Service

startfive shows a single live leaderboard of Instagram accounts ordered by how much has been paid for each listing. The highest amount holds the #1 position. The board re-sorts whenever a payment is confirmed; a listing that is outbid drops in rank or off the board. Rankings are entertainment and reflect payments only — they are not a measure of an account's value, reach, or reputation.

3. Listings

You may list a public Instagram account by its @handle. You represent that:

  • you own or are authorized to promote the account you list;
  • the listing does not link to chat or invite pages, sexual or adult content, or content that is illegal or infringes third-party rights;
  • you will not impersonate any person or brand, or use the Service to harass or defame anyone.

We may edit tracking parameters and shortened links, and we may remove any listing at our discretion, with or without notice, including for a breach of these Terms.

4. Payments

Prices are in US dollars. Payments are processed by our payment provider, Dodo Payments, who acts as merchant of record; your card details are handled by Dodo Payments and are never stored by startfive. A payment is only effective once Dodo Payments confirms it. Taking a spot costs at least $5 more than its current holder; raising your own listing costs at least $1 more than your current amount and is charged as the difference.

5. No refunds

All payments are final and non-refundable, including where your listing is later outbid, drops in rank, falls off the board, or is removed for a breach of these Terms. A completed payment is what claims a rank; it does not guarantee that rank for any period of time.

6. Content and intellectual property

The Service, its design, and its content are owned by startfive or its licensors. Instagram names, handles, and images shown on the Service are the property of their respective owners and are displayed as publicly available information. You grant startfive a non-exclusive licence to display the account details associated with your listing.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that rankings will always be accurate or up to date. startfive is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc.

8. Limitation of liability

To the maximum extent permitted by law, startfive will not be liable for any indirect, incidental, or consequential damages, or for loss of rank, profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid to startfive in the 3 months before the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for a breach of these Terms or to comply with the law. Sections that by their nature should survive termination (payments, disclaimers, limitation of liability) will survive.

10. Changes

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the operator's place of establishment, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
